Mobi Premium 訂閱條款（EULA）

This is an operational draft, not legal advice. Entity and product details in this Premium Terms are completed for operational use (not a formal solicitor review or sign-off). If English and Chinese disagree, English prevails. This document describes how Mobi Premium auto-renewing subscriptions work when offered; the main Terms of Use still state that Premium is not sold today.

These Mobi Premium Subscription Terms (this “Premium Terms” or “EULA”) supplement the Terms of Use and Privacy Policy. Subscribing to Mobi Premium means you agree to this Premium Terms. Anything not covered here is governed by the Terms of Use; if they conflict on Premium subscriptions, this Premium Terms controls except where law requires otherwise. Subscription-related personal information is described in the Premium Privacy Notice.

Who we are

Mobi Premium is offered by CIRMOYED TRADING INC (“Company”), based in Canada. Contact: admin@duomobi.com. Registered address: 1767-1711 Robson St, Vancouver, BC V6G 3B7. Principal place of business: British Columbia.

1. Eligibility

You must be at least 18 to subscribe to or use Mobi Premium. Do not purchase Premium if you are under 18.

2. Scope of licence

In addition to the licence in the Terms of Use, the Company grants you a limited, non-exclusive, non-transferable, revocable licence to use the Mobi app (including Premium features) on devices you own or control, only under this Premium Terms, the Terms of Use, and applicable store rules. You must not rent, lease, lend, sell, redistribute, sublicense, reverse engineer, decompile, or attempt to derive source code from Mobi except where law or our written consent allows.

3. Mobi Premium subscription

Subscription name: Mobi Premium (auto-renewing).

Plans and prices: We offer an auto-renewing monthly Mobi Premium plan. Actual price and currency are always as shown in the app and App Store / Google Play before purchase. The price, currency, billing period (for example weekly, monthly, or yearly), and any trial are always shown in the app and in the App Store or Google Play before you confirm purchase; this page does not list fixed prices.

Premium features are those described in the app and paywall. We may change, add, or remove Premium features over time. Ads: While Premium is active, the app does not show ads except reward ads the user chooses to watch (user-initiated).

Premium in a couple space: In an active couple space, if either partner holds an active Mobi Premium subscription, both partners may use Premium features. After leaving the couple space, the partner who did not purchase the subscription loses that shared access.

4. Payment and auto-renewal

Payment is charged to your Apple ID or Google Play account at confirmation of purchase, depending on which store you use.

Unless you turn off auto-renewal at least 24 hours before the end of the current period, the subscription auto-renews. Your account is typically charged for renewal within 24 hours before the period ends.

Purchases and renewals are processed by Apple or Google. We use RevenueCat to manage entitlements. We do not receive your full card number.

5. Manage, cancel, and restore

Manage or cancel Mobi Premium in your App Store account settings or Google Play subscriptions. Deleting the Mobi app or deleting your Mobi account does not cancel the subscription; cancel in the store.

After reinstalling or changing devices, use Restore purchases (or equivalent) in the app to restore Premium.

6. Free trial (if offered)

If a free trial is offered, it converts to a paid subscription unless you cancel at least 24 hours before the trial ends. If you purchase Premium during a trial, any unused trial time is forfeited under store rules.

7. Refunds

Refunds are handled by Apple or Google under their policies. The Company does not issue subscription refunds directly, consistent with section 20 of the Terms of Use.

8. Data and privacy

How we handle subscription and payment data is in the Premium Privacy Notice and Privacy Policy. Using Premium means you agree to that processing, including sharing necessary transaction data with Apple, Google, and RevenueCat to unlock and maintain entitlements, as law allows.

9. Termination

You may cancel anytime in the store; Premium usually stays active until the paid period ends. We may suspend or terminate your Mobi account under the Terms of Use; account termination is not a substitute for cancelling in the store. Premium access ends when the subscription expires or cancellation takes effect, except where law or store rules say otherwise.

10. External services

Premium may rely on Apple, Google, RevenueCat, and other third parties. Their terms and privacy policies apply. We are not responsible for third-party availability, content, or practices.

11. No warranty

Mobi and Premium features are provided “as is”. To the maximum extent permitted by law, the Company disclaims warranties of fitness for a particular purpose, uninterrupted service, error-free operation, or that any particular Premium feature will always be available.

12. Limitation of liability

To the maximum extent permitted by law, the Company is not liable for indirect, incidental, special, or consequential loss from Premium subscriptions or use. If liability cannot be fully excluded, our total liability to you is capped at the subscription fees you actually paid for Mobi Premium in the 12 months before the claim, or twenty Canadian dollars if you paid nothing. Nothing limits rights under Canadian or provincial consumer-protection law that cannot be waived.

13. Export and U.S. Government end users

You must not use, export, or re-export Mobi in violation of applicable export control or sanctions laws. If you are a U.S. Government end user, Mobi is provided as “Commercial Computer Software” and “Commercial Computer Software Documentation” with only those rights granted to the U.S. Government under applicable regulations.

14. App Store and Apple’s standard EULA

If you downloaded Mobi or bought Premium from the Apple App Store:

• Your agreement is with us, not Apple. Apple is not responsible for Mobi, Premium content, maintenance, or support. See section 21 of the Terms of Use.
• Apple’s Licensed Application End User License Agreement (standard EULA) applies to the app obtained through the App Store and applies in addition to this Premium Terms and the Terms of Use where it does not conflict.
• You and we acknowledge that Apple and its subsidiaries are third-party beneficiaries of the Terms of Use as they relate to your licence of the app, and Apple may enforce those terms as a third-party beneficiary.

If you purchase through Google Play, Google Play’s then-current payment and subscription rules also apply.

15. Governing law

This Premium Terms is governed by the federal laws of Canada and the laws of British Columbia, excluding conflict-of-laws rules, consistent with section 32 of the Terms of Use.
